Terms of Service

01Acceptance

By accessing or using Inspect Genius (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

02The Service

Inspect Genius provides software for capturing, drafting, reviewing, publishing, and storing property condition reports. The publishing inspector is the legal author of any report produced through the Service.

03Mobile app & app stores

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Inspect Genius mobile app on devices you own or control, for your internal business use, subject to these Terms.

If you download the app from the Apple App Store, you acknowledge that these Terms are between you and Inspect Genius only, not Apple, and that Apple has no obligation to provide support or maintenance for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You represent that you are not located in a country subject to a U.S. embargo and are not on any U.S. government restricted-party list. Your use of the app must also comply with the Apple App Store Terms and the Google Play Terms of Service, as applicable.

You can delete your account and associated personal data from within the app at any time (Settings → Account → Delete account) or by emailing privacy@inspectgenius.tech. See the Privacy Policy for what is deleted, anonymized, or retained.

04Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at security@inspectgenius.tech of any suspected unauthorized access.

05Acceptable use

You agree not to: (a) misrepresent the authorship of a report; (b) tamper with audit logs or verification hashes; (c) use the Service to capture imagery without legal authorization; (d) reverse-engineer, scrape, or otherwise extract bulk data outside our published API.

06Intellectual property

You retain all rights to inspection data and reports you create. We retain all rights to the Service software, the brand, and any aggregated, anonymized statistics derived from usage.

07Fees and billing

Fees are billed per published report at the rate specified in your order form. Invoices are issued monthly and payable within 30 days. Past-due accounts may be suspended after 30 days' written notice.

08Termination

You may terminate your account at any time. We may suspend or terminate accounts that materially breach these Terms after written notice and a reasonable opportunity to cure. On termination, you may export your data for 90 days; after that, we may delete it.

09Warranty disclaimer

The Service is provided "as is." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

10Limitation of liability

To the maximum extent permitted by law, our aggregate liability under these Terms will not exceed the amount you paid us in the twelve months preceding the claim.

11Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in New York County, New York.

12Changes

We may update these Terms from time to time. Material changes will be announced at least 30 days in advance via email and via a banner in the Service.
